Terms and conditions of sale
This is a translation provided for convenience. The French version is the binding one.
Article 1 — Purpose and scope
These terms govern sales concluded on greffeurdagrumes.com between Laurent Lévy, sole trader operating under the name Greffeur d'agrumes, whose full details appear in the legal notice, and any person placing an order, hereinafter “the customer”.
They apply to the sale of grafted citrus plants, rootstocks, seed parents, seed, and grafting and sowing equipment. Placing an order implies unreserved acceptance of these terms.
Article 2 — Living products
Plants are living organisms. Their appearance — habit, branching, foliage, colour — varies with the season, the rootstock and the year of grafting. Photographs illustrate the variety, not the individual specimen that will be dispatched.
The hardiness temperatures given are indicative figures, for mature, acclimatised specimens. The duration of the cold, wind, humidity, microclimate, the age of the plant and the rootstock all change real resistance appreciably. These figures are not a guarantee of survival.
We are entered in the official register of professional operators under number FR-0110126V. Plants are dispatched with the plant passport required for citrus within the European Union.
Article 3 — Orders
The customer selects the items, checks the contents of the basket, then confirms the order after accepting these terms. The sale is formed when payment is confirmed.
A summary email is sent to the customer. We reserve the right to refuse an order showing an obvious anomaly, in particular a clear pricing error or an inconsistent delivery address.
Article 4 — Availability
Items are offered while stocks last. Because production is seasonal, some varieties can only be dispatched at certain times of year.
If an item becomes unavailable after the order, the customer is informed and may choose between waiting for restocking, replacement with an equivalent variety, or a refund of the corresponding amount.
Article 5 — Prices
Prices are shown in euros, inclusive of tax. Delivery charges are added to the basket total and displayed before final confirmation.
The applicable price is the one in force when the order is placed. We reserve the right to change our prices at any time, with no effect on orders already confirmed.
Article 6 — Payment
Payment is made online by bank card over an SSL-encrypted connection. Transactions are processed by Stripe. We never have access to your card number: it does not pass through our servers and we do not store it.
Orders are prepared only once payment has been received.
Article 7 — Delivery
Parcels go out on Mondays, usually within 5 to 10 days of payment. Carriage is by DPD. Pallet dispatch is possible for large volumes: it must be requested before the order and may involve an additional cost.
We recommend grouping the items you want into a single order.
We deliver within mainland France and the European Union. Switzerland is not served, because of the customs and handling fees charged by the carriers. If your country does not appear at checkout, contact us: we will adjust the carriage cost where dispatch is possible.
Article 8 — Receiving the parcel and making reservations
It is for the customer to check the condition of the parcel in the presence of the driver. Any damage, shortage or delay must be recorded on the delivery note precisely and with a date — “subject to unpacking” has no value — then confirmed to the carrier by registered letter within three working days, in accordance with article L133-3 of the French Commercial Code.
Please tell us at the same time, by email and if possible with photographs of the parcel and its contents, so that we can support your claim.
Article 9 — Transfer of ownership and risk
Items remain our property until payment in full. Risk of loss or damage passes to the customer when the parcel is physically handed over, in accordance with article L216-4 of the French Consumer Code.
Where the customer chooses a carrier that we do not offer, risk passes on handover to that carrier.
Article 10 — Right of withdrawal
Non-trade customers have fourteen days from receipt to withdraw, without giving a reason and without penalty.
Withdrawal is exercised by any unambiguous statement sent to laurent@greffeurdagrumes.com, or using the form set out in article 11.
Items must be returned within fourteen days of that statement, in a condition allowing resale, with their identification label. Return carriage is at the customer's expense. As these are living plants, it is for the customer to pack and dispatch them with the care their survival requires.
A refund is made within fourteen days of receiving the returned items, or proof of their dispatch, using the same means of payment as the original order.

Article 12 — Legal guarantees
Irrespective of any commercial warranty, we remain bound by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Under the guarantee of conformity, the customer has two years from delivery, may choose between repair and replacement, and need not prove the defect during the first twenty-four months. Under the hidden-defects guarantee, the customer has two years from discovery of the defect and may seek rescission of the sale or a price reduction.
These guarantees cover the conformity of the plant delivered — variety, rootstock, stated size, health on arrival. They do not cover establishment after planting, which depends on soil, climate, watering and care, nor damage from frost, drought or pests occurring after delivery.
Article 13 — Growing advice
The guides and variety notes published on this website are shared for information, based on our own experience. They are not a commitment as to results. Growing conditions vary from garden to garden, and the success of a graft or a sowing depends on operations beyond our control.

Article 15 — Personal data
The processing carried out in connection with an order is described in our privacy policy.
Article 16 — Governing law
These terms are governed by French law. A consumer customer resident in another Member State of the European Union retains the benefit of the mandatory protective provisions of their country of residence.
In the event of a dispute, the French courts have jurisdiction, without prejudice to the rules of jurisdiction applicable to consumers.
